Terms and Conditions for tours, workshops and courses
These Terms and Conditions govern participation in (photography) tours, workshops and courses offered by JJDW Works.
By booking or attending, you agree to the following:

Jurre Jan de Wit, registered as JJDW Works, hereafter referred to as ‘JJDW’, ‘we’, ‘our’, ‘us’. Registered in Fochteloo, The Netherlands.
Customer:
Natural, legal person who (also referred to as ‘you’, your ,attendee(s), participant(s)) has booked a service (tour, workshop, course, etc.) through JJDW.Service or product:
Any photo tour, workshop, or course, offered by JJDWAgreement:
Agreement between JJDW and Customer for any purchased service or product. These terms and conditions are the base for any agreement on any purchased service or products through JJDW.These Terms & Conditions only apply to any services or products booked directly with JJDW and through the payment and booking system used by JJDW. For any services or products purchased through any third party, the terms and conditions of this third party will apply.

Registration/booking:
When booking a service or product through JJDW, the customer provides honest and true information about him/herself on the registration/booking form.
The Registration/booking form will contain all relevant information about the customer, for JJDW to process the booking and to get a good understanding about the customer and to see if the offered service is a good match for the customer.Acceptance of agreement:
The booking will be considered as complete and final once the mandatory, non-refundable deposit or full payment of the service has been made.Payments for tours and workshops that include accommodation and transportation will be done through a third party guarantee scheme to comply with EU regulations, see article 3.
Payments for other services, for example guiding only, can be made through direct invoice sent by JJDW.
This will be clearly stated when making a booking.The remaining balance, if any, must be paid by the due date specified in the confirmation email.
Bookings are non-transferable between participants and / or services / products.
JJDW reserves the right to refuse any booking or reservation without giving a reason.

In order to meet its statutory obligation to provide a guarantee, JJDW makes use of the guarantee scheme provided by STO Garant.
You can check that this is the case by visiting STO Garant’s website and verifying that the organisation is listed as a participant (www.sto-garant.nl/en/members).You can find all information relating to STO Garant at www.sto-garant.nl/en.
Whether STO Garant's guarantee applies to a particular (travel) offer made by JJDW is clearly stated for that offer.
The Guarantee Scheme specifies what the guarantee covers and which conditions apply. You can find the Guarantee Scheme on STO Garant's website (www.sto-garant.nl/en/downloads).
If STO Garant's guarantee applies to your booking, you do not pay the booking sum to JJDW but instead into the escrow account belonging to Stichting Derdengelden Certo Escrow, a payment services provider registered with De Nederlandsche Bank (DNB) and the Dutch Authority for the Financial Markets (AFM).
This trust account holds your payment in reserve until the trip booked has come to an end. If services are not supplied (in full and/or on time) due to the financial insolvency of JJDW, STO Garant implements the guarantee.
The Guarantee Scheme details how you can make a claim under the guarantee in such cases.

Cancellations by participants must be submitted in writing.
Cancellations made more than 90 days before the tour/workshop start date will receive a 100 percent refund of the amount paid, minus any non-refundable fees.
Cancellations made less than 60 days before the start date, but more than 30 days will receive a 50 percent refund of the amount paid, minus any non-refundable fees.
Cancellations made less than 30 days before the start date will not be eligible for a refund unless a replacement participant is found.
JJDW reserves the right to cancel or reschedule tours or workshops due to insufficient bookings, weather conditions, or other unforeseen circumstances. In such cases, participants will be offered a full refund or a transfer to another date.

JJDW is not liable for any travel delays, missed connections, or additional costs incurred by participants.
Travel and accommodation can vary per service and product. What is included and excluded is clearly stated on the specific page of the service or product.

Participants must ensure they are physically and mentally fit for the workshop/tour. Should any participant have a medical or health condition that may affect their participation, it is the responsibility of the participant to inform JJDW prior to attending the workshop.
JJDW is not responsible for any injuries, illnesses, or accidents that occur during the tour or workshop. Participants must carry their own health and travel insurance.
Participants are required to follow all safety instructions and guidelines provided by the workshop leader/guide.
If a participant feels unwell or exhibits any symptoms of illness, they are encouraged to stay home. Refunds for illness-related cancellations will follow the general cancellation policy.

Participants must bring their own camera equipment, including lenses, tripods, filters, and other necessary gear.
JJDW is not responsible for any damage or loss of personal equipment during the tour/workshop or course.
If rental equipment is offered, participants must sign a separate agreement and be responsible for the equipment's care and return of the rented equipment in good condition.

All images taken during the workshop by the participants remain their own intellectual property.JJDW Copyright:
Any materials provided by JJDW (slides, handouts, etc.) remain the intellectual property of JJDW and may not be reproduced or shared for commercial gain without permission.Use of Participant Photos:
By attending the tour, workshop or course, participants agree to allow JJDW to use images taken during the event (including photos of participants) for promotional or educational purposes, unless otherwise specified in writing prior to the event.

Participants are expected to conduct themselves respectfully and professionally toward other participants, instructors, and local communities.
Disruptive behaviour, harassment, or inappropriate conduct will not be tolerated and may result in removal from the tour/workshop without a refund.

Photography tours, workshops and courses are subject to weather conditions. In the event of poor weather, the itinerary may be adjusted or modified to ensure the best photographic opportunities.
JJDW is not responsible for weather-related disruptions but will make every effort to provide a valuable experience.

All workshop clients participate at their own risk and JJDW accepts no responsibility for injury or damage done to their persons or property. It is recommended that applicants hold their own personal Public Liability Insurance.
Personal Liability:
Participants are responsible for their personal safety and conduct throughout the workshop. JJDW shall not be held liable for any accidents, injuries, or losses incurred during the event.Third-Party Liability:
JJDW is not responsible for any damage caused to third parties by participants.Insurance:
It is strongly recommended that participants have their own travel, health, and equipment insurance.

By attending the tour, workshop or course, participants agree to release JJDW, its employees, and contractors from any liability, claims, or demands arising from their participation, including personal injury, damage to property, or other losses.

JJDW reserves the right to modify or adjust the itinerary due to unforeseen circumstances, including weather, safety concerns, or local conditions.
Any significant changes will be communicated to participants as soon as possible.

JJDW is not liable for any delays, cancellations, or changes due to events beyond its control, including but not limited to natural disasters, strikes, government actions, wars, pandemics, or other emergencies.

These terms and conditions are governed by the laws of The Netherlands. All disputes will be settled by the competent court in the district in which JJDW is located.

We are committed to protecting your personal data in accordance with applicable data protection laws. By booking and participating on any tour, workshop or course, you consent to the collection, use, and processing of your personal data, such as your name, contact details, and any images taken during the tour, workshop or course, for the purposes of organising the tour, workshop or course and enhancing your experience. We will not share your personal information with third parties without your explicit consent, unless required by law. All personal data will be stored securely and only retained for as long as necessary for the purposes outlined. You have the right to access, correct, or request the deletion of your personal data at any time by contacting us directly.
By booking and participating in a (photography) tour, workshop or course, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
